Terms of Use

These Terms of Use (“Terms”) govern your use of Votaroo, including votaroo.com, votaroo.app and the Votaroo apps (together, “Votaroo”), provided by Always Blue Software LLC (“we,” “us” or “our”). By using Votaroo, you agree to these Terms. If you don't agree, please don't use Votaroo.

Using Votaroo

Votaroo helps groups decide together by voting on options. You must be at least 13 years old to use it. You may use Votaroo only for lawful, personal purposes and in line with these Terms.

Votes and sharing

Anyone with a vote's link or code can see that vote's options, the display names of the people in it and the result, and can join it. Share links only with people you want to include, and choose a display name you're comfortable with others seeing.

Your content

You're responsible for the deck names, display names and other content you add (“your content”). You keep ownership of it and give us a non-exclusive, worldwide, royalty-free license to host, store and display it as needed to operate Votaroo. Don't add content that is unlawful, harassing, hateful, sexually explicit, infringing or misleading, or that impersonates someone else. We may remove content or votes that break these Terms.

Acceptable use

You agree not to:

• Interfere with or disrupt Votaroo, or try to get around its limits or security
• Scrape, copy or collect data from Votaroo, including restaurant information, by automated means
• Use Votaroo to send spam or to mislead or harm others
• Reverse engineer the apps, except where the law allows it

Places and third parties

Restaurant names, ratings, prices, hours, photos, phone numbers and directions come from Google Maps and other third parties. We don't control them and can't promise they are accurate or current, so check details such as hours and prices with the place directly. Your use of Google Maps content is also subject to the Google Maps Terms of Service. Links to other sites and apps are provided for convenience and are governed by their own terms.

Our rights

Votaroo, including its software, design, name, logo and mascot, belongs to Always Blue Software LLC and is protected by law. These Terms don't give you any right to use our name, logos or mascot. We may change, suspend or stop any part of Votaroo at any time.

Disclaimers

Votaroo is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that Votaroo will be uninterrupted, secure or error-free, or that any vote will produce a result you like.

Limitation of liability

To the fullest extent permitted by law, Always Blue Software LLC and its members, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue or data, arising out of or relating to your use of, or inability to use, Votaroo, including any visit to a place chosen through it. Our total liability for any claim relating to Votaroo will not exceed one hundred U.S. dollars (US$100). Some jurisdictions don't allow these limitations, so they may not apply to you.

Indemnity

You agree to indemnify and hold harmless Always Blue Software LLC from claims, losses and expenses, including reasonable attorneys' fees, arising out of your content, your violation of these Terms or your misuse of Votaroo.

App stores

If you use a Votaroo app downloaded from Apple's App Store or Google Play, these Terms are between you and Always Blue Software LLC, not Apple or Google, who are not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms for apps obtained from the App Store and may enforce them against you.

Governing law

These Terms are governed by the laws of the State of Georgia and applicable U.S. federal law, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or Votaroo will be brought exclusively in the state or federal courts located in Georgia, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time and will revise the date above when we do. If you keep using Votaroo after changes take effect, you accept the updated Terms.
